How long does a divorce take in Kenya?
The duration of a divorce in Kenya typically ranges from 6 months to 2 years, depending on the complexity of the case, whether it's contested or uncontested, and the court's schedule. Uncontested divorces where both parties agree on all terms can be resolved more quickly than contested cases requiring court hearings.
What factors determine child custody decisions?
Kenyan courts determine child custody based primarily on the best interests of the child. Factors considered include the child's age and needs, each parent's ability to provide care, the child's relationship with each parent, stability of each home environment, and sometimes the child's own preferences (especially for older children). The courts generally favor arrangements that allow children to maintain meaningful relationships with both parents.
How is marital property divided during divorce?
Under Kenyan law, the division of matrimonial property is guided by the Matrimonial Property Act of 2013.
